Hit-and-run suspect was deported 15 times in 15 years

An oft-deported Mexican citizen accused of driving drunk and fleeing the scene after blowing through a stop sign and crashing his truck into a vehicle, seriously injuring a 6-year-old boy, pleaded not guilty Wednesday to felony charges.

Lennox's uncle said that the 6-year-old kid suffered major injuries and went into surgery while his parents suffered minor injuries.

The family was returning home near San Diego after visiting Disneyland when the crash happened.

Police said Banda left the scene, but was taken into custody a short time later by Border Patrol officers.

"We did find out the driver of the truck was 2x over the legal limit for blood alcohol levels, and had been deported earlier this year for a prior drunk driving arrest".

The San Diego Union-Tribune reports that family members expect the child to fully recover.

Lennox suffered a long list of injuries, some including a fractured skull and bleeding from his nose and ears.

"I just hope the justice system does what it's supposed to do and things are handled properly", said Benjamin, Lennox's father.




After Border Patrol agents found the damaged vehicle, San Diego police arrested Banda-Acosta who was in the USA illegally again, despite his 15 prior deportations.

"Department of Homeland Security databases indicate Mr. Banda-Acosta has been repatriated to Mexico at least 15 times since 2002, most recently in January 2017", ICE said in the statement.

Banda's bail was set at $230,000.

A San Diego County public defender who represented Banda-Acosta at the court hearing on Wednesday could not be reached by Reuters for comment.

Banda-Acosta, who is in custody, is an immigrant from Mexico who is in the US illegally. He was riding in a booster seat when police say Constantino Banda-Acosta plowed into his family's vehicle Saturday night. Lake told paramedics he was fine.

He added that doctors said if Lennox's scalp laceration had been an inch further back on his head, "he wouldn't be here".

A GoFundMe page has been set up to help the family with medical expenses.

The woman told the station 10News her estranged husband was deported from the U.S. on or around January 10, but returned 10 days later.
