Trump delays effective date of travel ban amid court battle

In spite of the stays issued by these federal courts, immigration and tourism to the usa has slowed since the initial executive order. "As the government says, there is no doubt that this executive order 'has been the subject of passionate political debate.' But whatever one's views, 'the precedent set by this case for the judiciary's proper role in reviewing the president's national security and immigration authority will transcend this debate, this order, and this constitutional moment'".

The president's travel ban, first issued in January, and a revised order from March have been in legal limbo after federal judges put them on hold and appeals courts have upheld those rulings. Will we then be looking for version three of the travel ban?

In a statement, he said: "I am heartened by the decision of the 9th Circuit to maintain the temporary halt implementing certain provisions of the March 6th Executive Order".

"The Immigration and Nationality Act ("INA") gives the President broad powers to control the entry of aliens and to take actions to protect the American public".

Under the amendment, the 90-day ban won't start until court orders now blocking it are lifted. The 4 circuit chose a different path for its ruling.

Trump's suspension of the US refugee program also remains blocked. Two federal appeals courts have since upheld those lower court orders. Richard Hasen, an election law expert and University of California Irvine law professor, noted in an article posted on his Election Law Blog a dissent by Ninth Circuit Judge Alex Kozinski at an erlier stage of the travel-ban litigation.




Indeed, the President recently confirmed his assessment that it is the "countries" that are inherently risky, rather than the 180 million individual nationals of those countries who are barred from entry under the President's "travel ban".

U.S. Chief Circuit Judge Roger Gregory wrote that the text of Trump's executive order, which was challenged in courts across the country for targeting members of a particular faith, "speaks with vague words of national security, but in context drips with religious intolerance, animus, and discrimination".

The 9th Circuit on Monday narrowed Watson's ruling in some minor ways, allowing the administration to conduct an internal review of its vetting procedures for refugees and visa applicants.

The Supreme Court will decide whether to take the case on Wednesday.

Given the high court's looming summer recess-the spring term ends on June 26-the schedule is tight for everyone and tensions may run high this month even for the usually cool justices.
